After being fired five years ago, he just decided to launch a “sucks site” that is critical of his old law firm, a high profile personal injury firm. Is it mere coincidence that he practices personal injury law also, and that the sucks site would garner enough attention to move it into the first result for organic Google search results when his competitor’s name is searched online? No. We see this type of thing all the time at Dozier Internet Law.

You can read all about these sites in the book. And no, free speech is not the issue when a commercial use is being made of a competitor’s trademark with the affect of diverting prospective clients. The Chapter begins on page 158. Its title is “Circling Sharks”. For this situation, it certainly is an appropriate description. Both figuratively and literally.
